Friend - Why don't you wait till 9/18 and have this discussion. Oh, hold on, by that time, the rally will be a huge success and you won't be around here to show your face. Strength is in numbers and you will see the power of immigrants on 9/18. If we could reverse a visa bulletin with a rally of 350+ members and couple of hundred flowers, we will be headlines with 10000+ rally. This is going to be a historic event and why don't you take our side and be part of history instead of being an anti-immigrant cry baby.

I am eligible to file for 485 under the current (July) visa bulletin. My wife is transitioning from L1B(expired in May) to H4(Awaiting receipt) and is therefore out of status. I am wondering if she should apply with me (claiming that her status is H4) or should she wait till she gets her H4 (which could be in August).
My questions are:
1. Is it necessary that one's spouse should apply concurrently?
2. Can one's spouse (H4) apply for 485 as a follow up to her husband's application in July even if the visa numbers are not available (i.e in August when the visa bulletin says Unavailable)?
please help.

1).I came to USA on L1-B in 2003 October and the I-94 was till september-2006.
2). Then i changed my Visa to H1-B in 2005.
3). I was asking my employer to file for change of status from L-1 to H-1.
4). Those guys filed for a new H-1 and sent it to a consulate in India.
5). I was not aware of this and i thought i am legal till september the expiration date on my Visa.
6). Labor got cleared in July-2007.
7). Thought i would file for I-140 and I-485 together and found out that my I-94 was expired since September-2006.
What is the best course of action here to remedy my situation??
Any advice or details of a great Immigration lawyer who dealth with such cases before would be of great help.

You're in a tricky situation. If you leave the country now you could possibly face a 3 year ban on entry. If your H1 NOA did not contain a I-94 then you're possibly on unlawful stay. You could however file for a waiver with an explanation, but it is at the consulates discretion. I would find an Immigration lawyer and consult with him/her.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

1. documented / undocumented is a matter of immigration status..... no human can be illegal..... an activity can be illegal which makes a person undocumented...... as defined by human law...... but above human law there is another law..... which is defined by an entity more or less we all believe in..... how can a new born child.... a creation of the creator be illegal? delivery of a child is not just a matter of mother.... its a matter of another life being brought into this world..... how can that child be illegal?
2. even felons are not shackled to bed.... unless someone is danger to others..... how can a pregnant woman just about to deliver a child be danger to anyone else.....
3. i lost my wallet few days back.... anyone could lose their wallet sometime or the other ..... it happens..... and during that time we are all driving with a license..... does it mean we all must be shackled to bed when delivering a child......

Visas are divided equally -country wise quota - no country can have more than 7% of worldwide quota. Countries like India, China, Mexico, Phillipines that have more professionals in the USA. So these countries get retrogressed. EB(Employment based) greencard applicants from these countries have to wait.
Rest of the world (ROW) EB2 (ROW) do not have to wait, their dates are current.

Sorry but do not want to be a damper... But this thread does not give me the right feeling. I have been a member of IV i think from dec 2005 and contributed quite a few hundered dollars and just like this organization as a simplistic, good non-profit orgnization with good intentions....
But in this thread we see a taunt... which is more like we will not have numbers in DC and then some triades...
So far whenever such type of hate comments are posted, I have noticed that the IV core/ Super moderators either close the threads or blacklist the user....
But in this case we see periodically (i think a couple of times) that super moderators are only making comments that we need to prove numbers so join the rally....
Sorry to say this but i feel either this stage managed ( the triades) or super moderators/ IV core are taking advantage of this thread.... Both I feel are inappropriate....
If I am wrong in what i have stated - My apologies to Supermoderators / IV Core.... But If I am right then I think personally it is a sad day since it lowered the image of IV in front of a great admirer.

Thanks for your support. I usually don't respond to trolls. It's just best to ignore them. I think that in life in general, it's best not to get angry or harbor hate against anyone. It's self-destructive in the long run.
