Ok lets say that F1 is changed to a dual intent visa (Which i doubt will ever happen)
But lets say it happens then shouldn't they go to the end of the line
Is that not the same logic used by EB2 against EB3 Porters ?
What ever your logic the fact is currently F1 is NOT and immigrant intent visa and hence there is fraud currently. Now what happens in future is not deterministic but what is happening now is plain to see
What US will do is also non-deterministic. To gauge it, you can only try to understand the sentiments currently running in politics. Anyway, if you look at the issue I am bringing up, it has the potential to grant everyone their freedom. But maybe I am talking to the wrong person, because you already have your EAD .. well your brains are also welcome in solving the puzzle

I disagree that substituted labors has really impacted immigration..Those labor certifications that were once filed were thought to be used for some one anyway. If the original applicant wasn't laid off or hadn't changed plans, he would still be ahead of the current pending applicants. It's not the biggest of our current problems.
Companies should not have filed GC for all the non-qualified idiots who are currently got ahead of us.

This is not a legal advice to anybody, just explaining who I did!! Risk is yours!!.
On my passport "Surname" was empty. Complete name was under "Given Name". Assuming on passport:
Given Name: �Harjinder Singh"
Surname: ......empty....
Just went to Embassy of India - Washington DC. Filled a "Miscellaneous form" and under purpose pick OTHERS and write �Name Split". Then write on form what you want.
I requested " Split my name as Given Name = Harjinder; Surname = Singh".
Attach a photo on form, pay 20$ fee and collect a corrected passport next day.
As long as you are not changing the name this should be fine otherwise what will be in advertisement " My name is Harjinder Singh and I want to declare my new name is Harjinder Singh???" unless changing a name it seem simple 2 day task via Miscellaneous form.
Rest EAD / 485 I don't know because I am not at that stage yet.

Somewhat very good news. It turns out the total FY 2008 H-1B cap cases which they received are not 150,000 nor 133,000. The total number is 119,193. Accordingly the odds of winning in the lottery will be only 2:1.
For U.S. advanced or higher degree cases, they only received 12,989 and the H-1B for these people is still wide open and they can file the petition now.

What is the need of any sublabor demand ( per direction of this thread?) if they just retain 140 date ? There would no need in first place for any one to use it.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.

If you are serious about your proposal - please reach out to IV core and ask them provide the necessary guidance to take up this effort.
FYI - it's not easy to propose a bill but Sen. Jeff Sessions (R-Alabama) is your best bet. As much as you can lobby with his legislative office, you'll gain traction on your proposal. Good Luck!

And by extension of the same logic, you chose to come to this country to be a guest worker. You knew it could take long to get a GC and that there are PER COUNTRY LIMITS when you applied for GC. Why complain about it NOW ?

Your concerns about the per country limit will seem as useless bitching for ROW group in the similar way you see complaints from EB3.

Ok, so if I file the i-140/i-485 now and leave/re-enter the country with a new stamp. Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because by the time they are looking at the AOS application, I have already left and returned to the country??
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!
It appears that they look at status issues at the time the AOS petition is filed. That's when the "clock" stops. If you leave and re-enter the country it does not retroactively reset the "clock".

Thats wrong. This is not being posted by private people. It is being delivered and packaged by FTD/1800 flowers and such known company.
What u are saying would be true if people are sending envelopes with a 33cent stamp on it

I'm just saying make sure they are accepting them - can't you call FTD/1800 flowers and check if your flowers were delivered? It's a government building and they get really strict at times - I know because I work at one.
