    I had the first-hand opportunity to meet and see IV core members working for our cause. Really, it gives you the chill that thinking its the same GC everyone on this forum wants but the dedication with which they are approaching is amazing. There is no point talking about what we "could have done" after the congress session is over and god forbid, our bill doesn't pass through. 2008 is all about elections and the citizens, not too much of immigration will come to forefront, so please think.....

    Sideline onlookers> Till yesterday we had about 40.08% contribution and as of noon today we are only at 43.97%, contribution of 3.89% which amounts to around $2400 :) I bet we can do so much better after all we are so called "high skilled" immigrants....

    T I am not a core member, but I trust these guys, they have been working hard putting in their own hard-earned money for travelling, and carrying out IV work. At this point, IV really needs two things, more members and more FUNDS . IV needs you to contribute, even if it is $20

    Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.

    The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).

    That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).

    Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...

    That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.

    PD - Dec 2004 EB2

    First of all let me thank all of you who responded to this thread positively or negatively. I have a humble request. Please make sure that the comments that you post in this thread are not finger pointers to anyone else in the community. Please provide your positive or negative comments about this idea. Also make sure that your comments are not cynical ones which will just put this idea into the dust bin. If you can't motivate, please do not discourage others from getting some motivation and giving motivation. Without positive energy and a conducive environment, we will not achieve anything. If you have high cynical opinion, please hold that with you - as it will help you as well - because by doing that, you are helping this community to work on an issue with positive energy. If there is some positive outcome of the effort by this community, you too can enjoy the fruit. So, my point is, your biggest help would be keeping quiet. Let�s have a constructive and productive brain storming.

    Even after this brain-storming, if our conclusion is negative, we should not give up. We should continue to work on this and if this requires a legislative change, still this may be an easy one as it won�t add any new GC numbers to the existing quota. This just removes the UNCERTAINITY surrounds our life. What I meant was, there won�t be much ammunition that the protectionists and anti-immigrants can gather against this effort.

    I can completely understand the user Ganguteli�s frustration. He has a very valid point too, with respect to applying for I-485 when dates are not current. As I quoted earlier �A journey of a thousand miles begins with a small step.�. So, we should continue this effort in small steps instead of a big bang method. In this current economic environment, if our proposal is too big, it could get ignored within no time. Administration will say that, we will do this along with Comprehensive Immigration reform or something like that. We may add a reasonable addition to this proposal to fix the problems of folks like Ganguteli. Something like, if your 140 is approved and 1 year has passed, the person must be able to apply for 485 irrespective of whether his country is retrogressed or not. I am not sure about the legality of all these. That�s where the importance of this community emerges. If we can work together, we can solve all our problems in small steps.

    If IV and our community take this as a priority item to work on, I will provide $500.00 as an initial aid to this effort. I could offer more on the way.


    An interesting idea to say the least. Out of box suggestion.

    However, there are few things, from legal point of view, it needs to overcome. I will post my detailed comments this afternoon.

    Once again, this is a great idea!

    Here is why I am interested in this discussion.

    1.> I am from india and retrogression affects indians, hence I wish my community can fight against this in a democratic civil way as I have always said.

    2.> If ppl like you, who has no profile and who claims to have become US Citizen last week, comes here and fuels the fire to divide us - this is not going un-noticed.

    3.> I feel that instead of crying over small # of LC subs, we fight for something where everyone gets benefitted. If we are successful in visa recapture or end of retrogression, everyone of us would get gc if eligible. what effect of lc sub would be there in that case?

    4.> however if ppl like you come and make us fight among overselves, we reach no where. May be this is what you want. isn't it?

    5.> if a person is slightly over-weight, and if he is detected to have 2 cancers also - what should he do? worry about cancer first or that extra 2 pounds of weight? similary in current situation, the lcsub is slight over weight compared to cancer like 'large unused visa numbers' and 'unfair country qouta'.

    Labor substitution was never illegal unless you have purchased it. Hijacking the priority date is incorrect according INA. If you are not feeling pity about the fellow immigrants who suffered injustice (also from India) you are selfish a individual. FYI more than 60% of the 2007 July fiasco were substitutes
    I am neither IV core nor you (as per Profile). So all these guys can do is to bring this issue to their attention. So they can decide this battle needs to be fought or not.

    As for as fighting is concerned you are the one who started the fight calling them jealous. Since you do not have any points you are using such slurs. Please be gracious on such forums. Even if this is successful it will not affect you because your priority date was current when you applied the I-485. There might be delay which you can overcome by fighting for removing the country quota.

    There are so many 'Thank you' threads running and its hard to keep track of everything. Anyways, I posted this elsewhere and am proud to post it again here. Read on....

    I was just curious as to how many from Core Team will benefit from today's news. So I looked at the core team's GC details and here is the summary:

    1. 8 out of 12 Core Team Members WILL NOT BENEFIT from today's news.
    2. Because 6 of them are stuck in BEC
    3. 2 of them are in the final stages of their GC.

    But still they fought for this cause and never ever felt 'Why should I care'! Tears came running down when I looked at the details. You are just awesome. Though I am thankful today...I am thankful for the day I found this site and am thankful to god almighty for giving me an opportunity to know you all and work with you guys.

    I also sincerely hope and wish that you all will get out of the mess you are in right now and we are with you till the end.

    I totally agree. I dont know if I were in their position, if I would take the initiative and interest to aggressively pursue this.

    This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

    God BLESS all those current...Amen!!!

    The problem with the IOs is that they have so much work they don't have time to look at the folders for long. Some time ago I attended interview of my fiance's - she was sponsored by her mom. This was such a shock to me, the IO had NO IDEA what was in folder, asked stupid questions and attempted to deny the case improperly - and then I kicked in and explained the story.... That really sucks.

    I believe my case is pre-adjudicated.
    My lawyer says she has a way to contact TCS but not to NSC.
    Is there any way remind NSC about my case becoming current in september 2009?

    I think option 1 is best. We can request members to put the FOIA comment while paying. This is for IV leadership to track FOIA specific payments.

    Option 2: Who ever is actually setting up the paypal account needs to be aware of tax issues. We don't want to pay 30% of our $5000 to UncleSam.

    I want your input on a very important issue. So far I haven't heard anything proper from IV Core. We achieved the pledge goal. This really shows everybody's passion to get the real data.

    We have couple of options:

    1. We deposit all the amount to IV's regular account. In that case quite a few guys have asked for guarantee that first $5000 out of this money will be spent specifically for this purpose.

    2. We create a new paypal account, get all the donation in that acccount and one of us get the data from USCIS and share with everyone on IV thread itself.

    Please let me know your opinion ASAP. This is very important and quick reply is necessary.

    Everyone in this forum knows that I am a complete moron: I did not even know ROW and Schedule A. So it does not make sense in paying attention to my advice. I still have the audacity to request everyone to pay more attention to the following.


    Both sides have very valid points. A healthy debate on the topic is insightfull specially to morons like me. However, it is sad to see contributing members fighting over an issue that we may NOT have to resolve. I wish we had such a vigorous debate on generating contributions which will serve some purpose.

    I agree Macaca. It never ceases to amaze me, how willing and ready everyone on here is to start a rousing argument over the smallest things instead of focussing on the main goal!

    The petition looks great! I'm languishing in the queue since March 02 (PD early 2002). No IO is willing to listen to anything about my case. Sometimes I hink we should meet up with USCIS director and explain how unfair the whole system works and how individual cases have suffered!

    On the same note I have a question for the Gurus.

    My name is reversed ( first name and last name interchanged) on my SSN and hence on my credit cards, employment letters etc though my name is correct on my passport , H1 , I-797 and on files AOS.. etc.

    Will this pose a problem in the name check process?

    My attorney said I should change my name with SSN after EAD/AP arrives.

    Let me know ur opinions.
