Can someone advice on this.
Currently I am on H1B visa and I will apply my AOS before 17th august as dependent(Secondary applicant).
After applying AOS if I have to leave my job then will I be out of status since I won't be on H1 status and I won't be on H4 ?
Can I leave my job after applying AOS or I have to wait till We get receipts of 485?

You will be in "pending adjustment" status as a dependent, but since you're not on a H4 I am not sure what may be in store. Check with a good lawyer.

Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

This is ridiculous. Just trying to blame a good Sherrif.
I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.
Well you always have critics when you are doing a good job or he wont keep getting elected again and again.
getting re-elected doesn't mean he is right or he is doing a good job..... bush was also re-elected in 2004..... does it mean he was doing the right thing...... ask majority of americans they will spit on u'r face.... the same guys who were head over heals in love with bush back in 2004..... it just means that the majority of people who voted were stupid..... democracy has a curse..... that it has to live by the majority opinion which is not always right or good..... and using this curse as a weapon..... some men have made fool out of the majority.... in counties, cities, states and countries..... across the world..... so don't throw this bullshit of getting re-elected to legitimize an in-humane behavior.....

I would have to be an absolute moron to contribute to IV, and to work for it, if at the end it costs me more in getting a green card.
So, either you think that IV-ers from ROW are morons. Or you want them to quit, and turn this organization into an Indians-only group.
Its as simple as that. You can quote all the laws in the universe, and come up with all the fancy logic that you want. But what I have said above is what it all boils down to.
I do not care whether you contribute to IV or not. What I am writing here is law or facts and how it is affecting oversubscribed countries becuse of wrong interpretation of law. I am not here to unite or divide any group. In my level, I am contributing to end retrogression by sending mails to law makers. Even any law passes to remove retro, this misinterpretation of law is screwing Indians and Chinese. A EB2 person from Iran/Iraq/Pakistan with PD 2007 can get GC with in 6 months (right from PERM labor to 485 approval) why should Indian with PD in 2003 has to wait for ever?
My employer hired me not based on citizenship. They hired me based on their requirement for the job and my skills. They do not care, if I am male or female or Indian or Chinese or Iranian or Iraqi or Pakistani or European. I am penalized for just I am Indian not able to adjust LPR even I have priority date in 2003 after a long wait for Labor certification and 140 approvals. However, if I am from other than India and China I would have got GC with in six months even if my PD in late 2006. If a person with a Priority Date 2007 can become LPR immediately in EB2 category even if he is from a state sponsoring terrorism (provided if his background check is cleared). However a person from India having priority date in 2003 can not become LPR and sitting in dark to hope to see the light at the end of tunnel. How fare it is? Is it not the discrimination by country of birth?

If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally.
