Hello:
The company I am working with doing business for 40 years (less than 40 employee) and as per my lawyer, financially very good. I hired the lawyer and employer directly gave him financial docs. I am only one person with H-1 in this company's history and working for 4 years. Got labor approval on PERM EB2 (MS+1) and did concurrent filing with I-140 premium processing.
I received RFE regarding company's ability to pay. We sent tax files for FY 2005 (contains oct '05 to Oct '06) for being PD of Nov '06 and W2 for 2006 which showed 6k more than offered wage. Company started paying me offered wage one week after the PD and offered wage is 3k more than prevailing wage. RFE specified to show ability to pay by showing 2006 tax return or audited financial statement by 12 weeks. Any of this will not work as tax file will be prepred on Nov '07 for FY 2006 and audited finan. stat. costs a lot of money. My company has no clue and just planning to write a letter that they will not able to provide before Nov 07 and already submitted tax file upto Oct 06 which could be enough to find the financial status. They talk to their CPA and he advised to do so.
I am really not very fimilar with all these issues. What should I do as company is not able to provide above 2 things that USCIS asked for? Can I send my paychecks even started getting paid offered wage after one week?

I agree with nitinboston, Forget the haters.
We have to do something.If things work much better than waiting for GC just head over there. There are tremendous oppurinities available. US GC is not the perfect thing to get in life. People like Dhuribhai Ambani, Tata etc... did not work for their American GC. Keep your eyes open and keep on researching with different options.
Regarding IT, I don't think IT guys can only work on IT. you can study something new, change your field and be someone everybody would respect. Some of them in IV have stuidied in IITs, have double master degrees from US and waiting in a que. Start a business, have some goals rather than predicting about visa bulletin.
Majority of you are from India. In India you can hire engineers at a very low salary. I have employees working for me in India for Rs3.5K a month(non-tech) and Graduate enginers working for a salary of 5K/ month. If some of us can outsource jobs in India we would be millionaires within few years.

We should gather again and fight for the common cause of improving the GC process time. We should all be grateful for the interim benefits we would get, but we should not stop here. Let us gather again and fight for the next big thing.

My wait time is as long as yours, so I am not thinking about getting ready for citizenship just yet (lot can happen in 5 years). If the USCIS processing times are to be believed, they are supposed to take between 12 and 15 months to decide on a currently filed application (the server seems to be down now, so couldn't verify the latest status). There may be additional time differences depending on where you are located. And knowing how USCIS operates, backlogs are not unheard of (http://www.immigrationpolicy.org/images/File/factcheck/CitizenshipDayFactSheet09-16-08.pdf).
Here is a comforting thought - and someone correct me if I am wrong - but unlike the hectic GC process with all the "inequalities" among various EB categories, naturalization process is a level-playing field where your specific skills do not matter. Everyone is considered equal here, whether you have got your GC via EB, FB or even amnesty route. This makes sense too, considering that your value (to this country) as a citizen rests primarily in your voting right, and someone who can cook is just as good to vote as another who writes smart computer codes (no knock on the cook, my wife is a fantastic cook herself). This is why the "priority date" for your citizenship application is set at 5 years (of continuous residency) from the date printed on your PR card, irrespective of your GC category (the wait is 3 years for those with USC spouse). The only condition that permits some arbitrariness in the evaluation process is in establishing a "good moral character", which makes point #6 in my original list important.

you have a PD only if you are in a pool that has a restriction on the number of GCs that can be issued in one year. if you are exempt, basically you don't have a PD. That is, it is always current. You do wait for them to finish processing your I-485 for which there will always be a processing date, which may or may not be current for you.
Also, please don't give any such ideas to USCIS; they may like this particular idea :D
I hope USCIS has your thought process. Your thought process means that there is something in SKILL for US MS. I used to think that SKILL is only for non US MS.
Have you seen SKILL? Does it have anything for US Ph D and Post doc? You can have a US Ph D without US MS and you can be US post doc without US Phd? I wonder if they are SKILLed? Thanks.

One thing I did notice was the comment "it is soon becoming the voice of rich and/or EB2 Indians only -- all other categories will either have no direct advantage with the efforts put in by IV, or they will actually see some negative effect from its activities. But that will be the case with any organization that claims to stand for a particular class. In reality, every core group will stand up for it and only itself."

Hi Friends,
I checked my status and havent received any Soft LUD, but I received a FP notice couple of days back. I am not sure what this is for..My PD is Dec 2006 (EB3) and I received EAD/AP/I140 approved. I applied concurrently during the july fiasco and already done with FP on 2007 itself.
Now i am surprised why I need to , go for FP again. I am still in H1 and my EAD is expired and havent renewed.
Can anyone shed some light in to this FP notice ???

For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.
Seriously, how much more immature can we get?
Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.
Legal arguments were already dealt with in the other thread, there is no basis to sue, as the porting is well established law. So is the requirements for EB2.
Regarding the EB3 to EB2 shafting EB2, well, you already know that most people will not be able to port because they are not willing to change jobs, or that the company is bit too strict about playing with immigration laws.
Also, a point to be noted when you say EB3 has had the opportunity -- you too had similar opportunities. You too could have been EB3, gained experience and converted to EB2. Instead you decided that it was in your best interests to follow your dream of getting a PHD -- a choice, I dont think you are be ruing, but for the fact that you find yourself placed behind all the guys who did not do PHD.
Plight of EB2? I think not. Even with EB3-to-EB2 porting, priority dates are well ahead of EB3 (even without the current jump, EB2 was around mid 2004), and now, I guess when it returns to normal, would be around 2005. So while not exactly current (like EB1, shouldn't they be "similarly entitled" to have a superior lead times), the wait times for EB2, compared to EB3 hardly justifies it to be called "plight".
But then again, to each his own. EB3ers other EB2ers waited almost 3 years for our LCs, people with 2006PDs did not even wait 6 months for it (both EB2 and EB3) -- and worse still are people stuck in BEC (who waited 4-6 years). And yet people in 2006 complain that they have "horrendous wait times".
EB3s saw tons of people getting through substitute labor, people who have no right to cut into the line ahead of us, significant portion of these cases (including EB2 substitution) are fraught with fraud, however the law was weak, and there was nothing that we could do to prevent such things. Lawsuits are useless for us to weed out such applicants, or even question their earlier PDs because they are protected by the then current laws.

13 years since I landed in this country.....finally, I got the approval email 15 minutes back. I am not sure how to express my feelings (or lack thereof).
I want to thank the following guys from the botton of my heart.
1) KubMilegaGC - who gave me support in September or was around for sometime in October to check on my status
2) SeekerOfPeace, KewlChap and fatjoe - for all the valuable information they have provided. Thank you so much guys!!
I did the following:
1) Took around 10 Infopass appointments, with the last one being today morning at 9 AM PST. IO told me that my case was under review since July 2009.
2) Attorney reached out to AILA liaison
3) Sent DHS-7001 to CIS Ombudsman
4) Letter requesting USCIS secretary Napolatino to inquire about the delay in my case
5) Letter to first lady last weekend requesting to inquire about the delay in my case
6) Several inquiries were made by Congresswoman on my behalf
7) Inquiry was made on my behalf by the senator
8) Opened several SRs - I think around 6 or 7
As a result, I now have around 30 different responses from USCIS/DHS. Looking at each response, it makes me believe that they have not even cared to look at my case and have just pulled out a response from a standard set of responses.
I believe what really helped me is a phone call using the POJ method to TSC. I was fortunate to get a hold of a very nice and polite IO. IO walked me through the entire process and to my utter disbelief told me that my case was still sitting in the storage area and collecting dust (this was 2 weeks back). While I was on the phone, the IO sent a request to the folks in the storage area to pull my file out. Luckily for me, the file was in one of the storage areas in Texas itself. Once the file was at the Texas service center, it sat in the holding area for almost a week . It seems like the officer picked up my file sometime at the end of last week or earlier this morning.
Edit to the post: In hindsight, I think the delay in my case was because I had 4 I-140s (2 from RIR labor and 2 from PERM, one each for EB2 and EB3). I think whenever the IOs looked at my file, they thought that my case was not current. The IO I talked to specifically put in a note for the IO to look at the EB2 140 (June 2004) and not the EB3 I-140 (June 2004) or the I-140s that I have from July 2005. I dont know what to tell my attorney, not sure why they had to file 140s in EB3 for me.
Once again, thanks to everyone who has supported me to get through this painful process. Last 60 days (since September 1st) have been very painful for me.
Good luck to all EB2 who are still waiting and to all the EB3 folks, I hope you guys become current soon and get your GCs - I really really admire your patience.

You need to find a new employer and a new sponsor. Sorry its harsh but its the best advice we can give you.
I doubt anyone has been through my situation because most of you are high or higher-paid IT professionals. In my case, my company's immigration attorneys have been requesting the prevailing wage over and over for more than a year noiw (in order to get me started with PERM) but the prevailing wage always comes back way higher than what I am getting paid! Evidently, I am severely underpaid, and there is no light at the end of my tunnel unless my company matches the prevailing wage, which I doubt they will do. I used to laugh at those that called H1B the "modern day slavery", but now I am not laughing anymore. Has anyone at all been through this ordeal and can at least share a shoulder to cry on? Thanks guys

I want to thank everyone for contributing their personal story, I as an immigrant understand the importance of Green Card. We have worked dillegently over the years, sacrificing our personal dreams, our spouses sacrificng their personal dreams.
I am an optimistic person and I believe we will see a positive response.
However with the current status of the economy, just asking for visa recapture will not help, we cannot bring a change based on one side of the bargain, what we need is a two way bargain. What we need to do is offer business deal, let them know that we do care about the economy and would like to contribute to make this country stonger, as it was in the past.
The congress will do anything to get rid of all these homes off the market, if we add our intention's of buying homes in a our personal stories, they will think it from their side of the benefit as well.
In all you stories please add you intentions to buy a home, as without greencard you do not want to take the risk.
The downfall of the economy started with the housing crisis, and the economy will bounce back with a substantial improvement in the housing market. WE NEED TO INCLUDE OUR INTENTION OF BUYING HOMES
Infact, we should also send emails to realtor association, let them know our intentions, so they can communicate it further to the congress.
Guys you all are incredible and have contributed your valuable time and effort in IV. So I humbly request you all to please channel this effort lucratively for the other side as well. Remember the quote? BEGGARS ARE NOT CHOOSERS

Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. However, there is no specific memo to address this situation (Transfer). It is all depends on the individual adjucidator's logic. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. If the deny/issue RFE, you can not counter act as there is no secific memo or policy by USCIS in this case.

Although my lawyer confirmed that one can still have a valid H1B status after travelling using AP. My co-worder is still in doubt. Our corporate attorney seems to be clueless for this tricky situation.

Looking at the poll it seems that most of the EB-3 pending are from before Jan1 - 2005 . Seems like anyone who filed in PERM from 2005 onwards was wise enough to file in EB-2 or converted to EB-2 . We are in for a long wait .

I understand that your priority date is based on country of birth. I have read that you can use your spouse's country of birth. What if you have nationality in a country for over 20yrs but born in India. My parents emigrated to Europe when I was three months old, and I was naturalised there. The spouse rule doesn't apply to me because my wife is born in India too. Is there a rule anywhere that makes you eligibile to file under a particular quota if you had nationality in that country for a VERY long time? I was told no, so throwing this out to the group for advice. No hopes that I will hear otherwise.

Lack of contributions will reduce our investments in lobbying efforts and that will hurt our chances of overall success. In the last 3 weeks we have received just above 2K. This will be hardly of any consequence when you buy lobbying benefits from the top firm in the country. We will simply invest as much as we can get from members. If members pay us less, we will be able to get less. Provisions in the Omnibus bill are not going to be easy.

1) On our own IV site, we can consider adding google ads only on Forum pages. However before that we need an assessment from someone that is an expert in google ads to calculate how much we can earn via google ads. Experts in this area can contact us.
2) Advertising is expensive and we cannot afford it. If anyone has contacts with websites, pls use those contacts and get us free space. We can put banner ads on those sites
3) We had $20 as a minimum amount and even then we got only 300+ people to pay. Infact, since most who could have contributed more, only contributed $20 our contributions went down significantly and we were unable to keep up with the Lobbying expenses. At that time several people complained that $20 is too high and it should be $10 or $1. This has been discussed several times on the forum and we have answered many people same question. If people think the value of the effort we all are putting and the price of increasing the chances of their greencard is just worth $20 or $5, then I do not think we should even pursue this effort and even keep this website up.
4) This is a good idea. Next time I start spotlight thread, I would request members to donate if they found the topic helpful. Likewise all active members who help others on the forum by answering their questions can request readers to consider donating if the answers were helpful.
5) This is tough to implement without knowing who is conducting such campaign and if the person can be trusted.

I called of them, took me less than 15 minutes. i am sure everyone else can call too. The selfish brats who have EAD's and are acting ignorant, remember if something goes wrong you could be stuck on EAD's for another 5- 10 years. The point is, we all as a highly skilled immigrants have an obligation to help ourselves and the ones who are stuck in this limbo till we get our GC.
You can either choose a piece of pie or take the whole cake home for your family and friends. Life is all about choices and a man is as good as his word. So give out your good word and help the others. 15 minutes that's it.
