Please see the response that I received from VisaLaw.com
The SKIL Bill is a proposed piece of legislation that would increase the
number of H-1Bs and green cards. It is included in the comprehensive
immigration bill Congress is likely to consider this spring and will
hopefully pass in the fall.

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.
PD Dec 2005, EB2, RD for 485 Sept 2007. Welcome notice August 5 2008.
For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....
For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.
As regards this forum. I never contributed but found this to a good source of information.
bye bye:)
while announcing your green card? sigh.

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.
Folks
Keep the jokes aside, this is not another thread which come up every now and then ( as i thought initially).
This is really serious question or looking for serious opinion.
Aristotle : if you have doubt that your earlier 140 will be canceled, once you move to new job , then consider waiting ( till 02/15 atleast)

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.
We should talk to the senators...and contribute funds
Lets ask 1v if its ready for the challenge to lobby for the unused visa numbers.

What works for someone may not work for us. VXG and others were lucky we are not as simple as that which does not mean that we left any stone unturned...it just doesn't work that way.....but again will keep on trying...
has anybody tried calling USCIS as the proxy applicant..I mean has anyone as a primary called USCIS for their dependent....the reason I am asking is I need to do that....I am sure there is no "sex" in the file and there is no way for them knowing that I am the primary applicant or not.
SoP
I have tried it several times. You can talk on behalf of your spouse. But your spouse has to be there at that time, as the CSR first asks if that is your case. There is no need to tell lies, you can always say that you are enquiring about your spouse. The CSR makes sure that your spouse is there at that time, and talks to your spouse first before talking to you about your spouse's case.

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card. How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful. We dont want to stop there.
LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING
I hope you guys are with me..looking for your comments

We need active participation from members for the action item listed on this thread. CHC member are taking a very hard stand on the 3 bills introduced by Lofgren. If members (esp. constituents) don't call in large numbers and urge the CHC members to support the bills. The 3 bills may not even see the house floor. CHC members want only one immigration bill (CIR), nothing else is accepted.
Please ask u'r friends and colleagues (who are constituents of CHC lawmakers) to participate in this crucial action item.

Don't debate. Send the E-mail NOW!
We can debate in pleasure later. I have created a poll to keep count of how many have responded to our request. So far it's just a handful. Wish IV members were as dedicated as the anti-immigrants at ALIPAC.
Folks, your silence is killing our cause. Don't fret and fume later when you get the 'Leave Immediately. You application is cancelled' notice. Remember then, you were responsible for you sorry state due to your silly inexcusable inaction.
It's useless to discuss with bigots at ALIPAC. They don't want to understand us!. Why do you think they didn't link to our website? There's so much you can do to those who run away from the truth, and hide their heads in the sand like an ostrich.
When we cannot make the 'Great Egoists' of the anti-IV immigrant crowd to see reason for a cause that benefits them, what chances we have with bigots who have a vested interest in opposing us?
I am still debating whether to call in or to write - but I will definitely do one of the two. I just read the other thread linked to by 'internet' above & thought I would say a couple of things to the losers at alipac who worship racists like tancredo and lou:

Skilled, Legal Immigrants To March In A Protest Rally In Silicon Valley
July 12, 2007
What
Hundreds of legal, highly-skilled workers, who feel disappointed by the recent "flip-flop" enacted by the Department of State (DoS) and the United States Citizenship and Immigration Service (USCIS), with regards to eliminating the Green-Card processing delays, plan to stage a peaceful rally to bring attention to their issues and to demand a fair and equitable treatment.
Where
The New City Hall 200 E Santa Clara St San Jose, CA 95113
When
July 14th, 2007.
Planned Route
11:00 AM: Meet at San Jose City Hall at 200 E Santa Clara St.
11:30 AM: Go to the square in front of Dr. Martin Luther King, Jr. Library (150 E San Fernando St).
12:30 PM: Walk towards 635 N 1st St through S 4th St, E San Carlos St, Market Street and N 1st Street.
1:15 PM: Arrive at 635 N 1st St and stay till 2:00 PM
2:30 PM: back to City Hall
Why
Silicon Valley is the world’s most advanced crucible of innovation, an example that countries all over the world have tried to emulate. The success of Silicon Valley as a global hub of innovation has a lot to do with it being the world’s foremost melting pot of highly skilled immigrants. In San Jose, the heart of Silicon Valley, these highly skilled, legal immigrants who want to continue that tradition of innovation by becoming permanent residents of this country will stage a peaceful protest rally to bring awareness and attention to their issues.
The people gathered at this peaceful walk are already huge contributors to the innovation edge of the US but their potential is still not fully tapped as it is still being hindered by unreasonable delays and bottlenecks in the process of gaining permanent residency (green-card).
With this effort, the skilled, legal immigrant community hopes to create awareness about their predicament and express their anguish and frustration at the reversal and the lack of action from the Government. These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. With the San Jose rally, the community of skilled, legal immigrants wants to put focus on people who have abided by the law, played by the rules and ask for a fair treatment and attention to their issues.

If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)
Regd AILA lawsuit i believe they are deliberately delaying so that USCIS change the Bulletin to C on its own ( from the fear of lawsuit). On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...
I strongly believe that AILA and USCIS are cousins with the same last name. I smell something fishy when AILA files a lawsuit against its cousin.

Is this a parody post? How exactly is the law favorable to EB3? Just because they are allowed to file in EB2 later? Does this mean the law also favors children because it allows them to grow up? EB2 is in 2006. EB3 is stuck in 2001. "Plight"? Give me a break.
