Yep, that's "bull period". But assuming AOS bulletin mirrors CP bulletin, it looks like USCIS has decided to play with EB2-India. According to its own process, if USCIS might be working then this bulletin was not expected. 2 things I can think of. (1)EB3-ROW (From which numbers flow to EB2 -ROW then Eb2-countries) is confirmed empty and thus EB2-ROW is empty too (2) Somehow abrupt decision. If it is no:1 then it is really good news. But if it 2 then it will be bad for EB3-India as EB3-India is the MOST suffered lot during 2002-8. and Per country limit will make it more suffered with this illegitimate forward movement of EB2-India. I totally agree. They want to issue visas to all of them in a year... They will have more RFEs for legals than illgeal so people should work towards their temporary permnanent residency that is Z
You can call Jose in Mexico and they ll deliver a passport in less than a week. ALL WE NEED IS TO REGISTER A LAWN MOWING FIRM and then BILL THE CLIENT at 100$/Hr for first designing the plan for the mowing on a computer and then getting a MEXICAN to do it for us. ...;-)

I didn't find where in the PDF AILA is saying the definition is illegal!
They provide one example a court ruling where the EE definition was established in the case of an insurance agent. But such an issue has already been address by the EE memo by USCIS (Temporary/Occasional Off-Site Employment).

HLG has confirmed that the CIS is not returning I-485 Applications back to those who filed I-485 during the first week of July. This is leading many to speculate that the CIS may reverse course and re-re-amend the July Visa Bulletin; whether the Visa Bulletin actually reopens remains to be seen. HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

my 2 cents!!
if you are single and apply for 485 and get a EAD can still being ur wife from India on H4 as long as u DO NOT use EAD and DO NOT get 485 approved.
EAD to me has major benefits for the spouse. I think everyone agrees that 485 retrogression gona happen ... so if that happens u cannot get a 485 approval or add ur wife till almost close to 485 approval .. as ur PD wont be current. In this period u will never be able to use EAD as ur dependent will go out of H4 status ...
Also it is never recommended to use EAD and maintain H1 status ... so to me if you are single and have no plans as of yet to get married u will not use the interim benefits and pay EAD fee every year.
u will be in the 485 queue and if anything changes about green card u are atleast far enough to not to start ur application from beginning... also if for some reason u decide to use ur EAD the way around is ur wife to get another Visa like F1 ....

Plus, to add to the complication, I've also confirmed ticket to meet them at Frankfurt on their way to US. My Euro vacation for a week would collapse and have to cancel everything.
I'm try to keep myself sane. There are much worse situations people are facing in this forum ( for example, a ninth pregnant lady getting laid off).
Just hoping (and praying) that this can be solved smoothly.

I believe it was last year(not sure exactly) when USCIS started this new initiative where the AILA members can send an email and "Remind" them that a particular case is current. Basically you will send an email with the subject
EB I-485/SEPT or EB I-485/OCT or EB I-485/DEC (Month of the VB when you will be current)
and the body will have just the A #s
A123456789, A987654321
Note if you have multiple A#s (self, spouse etc) seperate it by comma.

You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!
The best way to find out the reason for reopening is to call USCIS. But since this is a I129 petition only the employer or the attorney can get any information since USCIS will not disclose any such information to the beneficiary. If the previous employer agrees to call USCIS, things will be clear.

Less than 800 contributions is such a shame.Assuming all the 3000 are affected by the retrogression it just doesnt make sense not to donate anything at all by the remainder of the members. People will have to understand how much of a difference it would make if everyone contributes.
Looks like the donors who have already donated have to donate all over again and that in double to make up for the deficit and to reach 150k

If you heard what the restrictionist lawmakers have said about what to do with illegal�s, this retrogression makes sense. The restrictionists want to make life miserable for illegal�s by making it difficult for them to get jobs, this way the illegal�s would go back on there own.
They are trying to do the same thing with us legal�s (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.
I smell a huge conspiracy behind all this USCIS, DOS mess. I believe the only reason they did is to make legal immigrants life miserable. They did all this so they waste EB visa numbers again this year and make legals wait for years before they get LPR. By the time the an individual numbers comes for the green card some of them might become illegals and some after years of frustion have gone back home.

often i'm amazed by the knowledge of some of the posters here...... but more often i get a laugh out of stupid ideas that r thrown around...... for example u want something big.... want to send transcript..... blacking out the name...... if there is no name on the transcript..... how will anyone know if its genuine...... so u r still afraid of someone knowing u'r name... but u want to do something big....... that makes real sense...... if u know what i mean..... then u want someone else to do a rally....... r u going to come to the rally?..... how will u hide u'r personal information when u come for the rally....... maybe time to take out the Halloween nixon mask.... to protect the personal information/identity..... and for the hunger strike.... lets have someone with a nixon mask do hunger strike...... we could just say that its not me who is doing the hunger strike.... its president nixon doing hunger strike on my behalf....... great idea...... by far the best one ;)

maybe we should have a 'sounding board' section where such threads can be started where you can cirb all you want about desi companies/consultants and other issues you want to get out of your system. You do realize that many people read these threads. Spritied discussions are great but upto a certain point and if they help the cause.
We are a small community here and all of us are stuck in a problem we DID NOT create. we are a part of a system that is broken. Instead of crying about problems, lets try and figure out ways to solve one for a change.
if people cannot contribute financially, conrtibute your time and talk to people about IV. Try to meet sucessful/influential immigrants and see if they can help us out, see if they can help us with their contacts. Try to seek people who are stuck in this mess and educate them about it. Get leads on people who can help us out.
Start a thread that mentions what you have done to help IV maybe people will learn from that
