You can go online and schedule an appointment.. You would need select service on a pending case.. There is no option for pending name check, you have to go the window and explain.. Depending upon service rep, you may or may not get any info... I am trying to figure out if something can be done in situations like ours... FBI name check was a major problem for may people and it took years in some cases.. But, there was law suite and judge ruled that a case must be adjudicated if name check has been pending over 180 days. This helped in clearing large no of pending cases.. A new memo was issued which stated that IO has to get an approval from head office if name check has been pending for more than 180 days...

Hello All
I applied 140 in EB2 and got an RFE on Education.I have a Bachelors(3year) and masters(2years) with 8 years of experience.I have submitted an education valution with the petition still got an RFE asking to provide one with the following points
1)Consider formal education only, not practical training experience
2) State the collegiate training was post secondary education i .e. did the applicant complete the United States equivalent of high school before entering college
3)provide a detailed explanation of the material evaluated and how the evaluator has reached their conclusions rather than a simple conclusive statement
any one please help who has gone through this before

You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.
Thats cool. I'm sure no one wanted to attack this member directly, but there is a reason why people jumped on the 3 year degree, especially since this is commerce, for a technology job.
I have worked with europeans with 3 year degrees. Many Russians love the BSc physics
3 year degrees are popular and the first choice in many ROW countries (only). I'll leave it at that.
But I have been involved in hiring for quite a few of the top 10 companies in India, and I do know what qualifications they look for and ones they don't look at.
There are exceptions like bugsbunny mentioned - There are some who come from poor families that can't afford the 4 year degree, even at $100-200 a year.
They are too few Ivy league/reputed 3 year degrees in India, unless the field is arts, Law, economics,...
If you don't qualify in the top 5%, you have to shell out $1000-$2000 a year for engineering degree.

Agree with macaca, It is not fair to expect a member to contribute the moment s/he joins.
Suggestion: IV membership should be free for the first 3 months, after which there should be a minimum $20/per month to keep your membership and log in.
Also at that time a member needs to update his/her profile to include contact information. This way we encourage new people to come study the issues, gain trust with IV and IV gets real people with real names that can be contacted if and when there is a need for mass-campaign.

@krishmunn thanks for your analysis too , i had sent him a bunch of emails about 10 of them and he never responded to them, when i called him about why is he not replying to my emails he said i cannot have any email conversation with you, it did not strike me then why ? but after talking to all the guys here i understand why he said so, i do not know if this would be enough . but i am just preparing my packet to send to DOL

Well i really appreciate your concern and i wish that you were a part of my employers team, but i have my tickets booked and bags packed . I would now empower people from all over the world to come a little more prepared on H1B to US. I admit to being dumb before landing here but i have gotten my much important experience which i will pass on through fake busting.

It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.

IV has to convince the government that this mess was created because close to 100000 visas were WASTED/UnUsed while BEC was busy(or not busy) sorting through the cases. If it is the mistake of a govt department, then the govt should fix it by recapturing these visas. They will act only when you make them look bad or file a suit against them. Why hasn't IV been able to push a simple argument like this????

Took an infopass to find out why my spouse's case was not approved. A rude IO told that the background check was not completed yet, and it would take 30-60 days. Asked us to wait for 30-60 days. She looked and talked rude, so I did not ask her "if the background check was started or not". So, the question is how to expedite the background process, so that it will be cleared.

Cannot argue with your experience. But I still think providing a convenient automatic way to pay small amounts for a specific period of time will help. (the suggestion of $30 over 6 months or 60 dollars over 6 months etc.) Sure people can do it on their own, schedule it, remember it and have the will to do it et al.
But when I put myself in the donor's shoes, it feels like the old times when there were no automated payments for electric bills. :D
This has been discussed umpteen number of times, but I am going to share a personal experience here (shared once already on a similar thread).
For the last state chapter (Diwali Mela) event in North CA we were accepting ANY AMOUNT for a contribution, but were suggesting $25 or $50.
How many contributed? About 20 from a state chapter that boasts of 150+ members.
The fact is, people do one of the following:
1. look at the recommended amount and contribute that amount (most of our donors were $25, and a few paid $50)
2. pay a high $ amount simply because (s)he is convinced he wants to help as much as possible! (Most of the volunteers for the event paid $50 or more, and three of them paid $90/$100 each)
3. DO NOT pay, no matter what, as they are not convinced it will help reduce their waiting time
One more time... IV is not turning anyone away. If you can only contribute $10 a month, please feel free to paypal it yourself to donations at immigrationvoice.org
Like the squirrel who helped Lord Rama construct the bridge (sorry for making this a slightly "Indian" post, but can't think of a better analogy) every small bit is going to help IV, and will be most appreciated!

I agree completely with the OP. Education should be rewarded. People with higher education should be rewarded likewise. PhD > MS > B.XXX. If you have done masters and possess higher qualifications but had to apply in a lower EB category it is your problem or the job you applied for does not require higher qualifications. Either way, it is not USCIS prob.
I also agree with the fact the OP mentioned that MS folks and PhD folks who sweat out eventually end up losing more financially. This is the first time I am seeing some relief/reward for higher qualified people. I have seen people (have friends too) who came in 2000 straight on H1 and have been making big bucks since then and stuck in EB3. I have seen my friends port to EB2 and get GC. All this makes me feel like I have wasted 2-3 yrs in getting a masters. It is time we got rewarded. This does not mean I want others to be punished. I am saying people with higher qualifications need to be rewarded.

You are also right that very very rarely do you see a mature discussion in these forums. which is why I just keep away. I just laugh at the sillines that is often displayed here. People dont want to see what they dont want to see. Just few minutes back I saw a post where the OP claims to have entered the country in 1999, applied in 2004 and got his GC. He says he "has been waiting for 8.5 years". thats silly. he applied in 2004. so the wait is only 4.5 yrs. If that was the case I came to this country in 1999. I should have gotten the GC before his. should I crib about it now?
Btw, I am in EB2. I made a choice to do my masters expecting some benefits. What use is the degree if it doesnt benefit me? No one would be going for MS and PhD if they are all same.

Good idea. I start with my contribution of 25 dollars(sending check today through Bill pay) in addition to 150 that I have made before.

How about this - let us have a couple of volunteers call/email people asking for $25 contribution. If we can get 1/2 of 3000 people contributing $25 each, we will get to about 120K. I am ready to take initiative in this - core group, can I get this initiative going?
