Why are you so PROUD to be an American? Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country

Why shouldn't he be proud? I am sure he had to struggle to get his GC first as we all did and then wait to become a US citizen. 06/03/2008: House Returns to the Session Today After Memorial Holiday Break With Various EB Legislative Bills on the Shelves
* Both the House and the Senate will start picking up the legislative bills from this week and some of the employment-based bills will come to their attention as time moves on, such as Conrad 30 extension bill or Conrad 30 program improvement bill for the international medical graduates (current law already sunsetting two days ago on June 1, 2008) and religious worker immigration bill which will sunset at the end of September 2008. These two bills passed the House waiting for the Senate action.
There are many other immigration bills pending in the House and the Senate, some of which were attached to the Iraq War Emergency Special Spending bill in the Senate and all of these bills were killed by either the Senate majority leaders or hardliner minority Senators primarily related to the AgJOBs bill which was considered by the illegal immigration relief opponents as an amnesty legislation which the Democrats attempted to pass as part of the national election year strategy.
The employment-based immigration bills are currently facing a strong resistance from the comprehensive immigration reform advocates opposing piecemeal immigration legislations and deeply tangled in the election year party politics. The comprehensive immigration reform proponents appear to take a strategy of holding the immigration legislation at bay until next January or February, while the employment-based piecemeal immigration proponents want the Congress to pass these bills before the end of the year. As the primaries of the Democratic Presidential nomination are about to wind down and the election politics will pick up the heat of steam of the presidential fights between the Republican candidate and the Democratic Candidate, both of the candidates may noticeably try to move to the center to grab independent voters, giving added strength to the comprehensive immigration reform proponents as opposed to the employment-based piecemeal immigration reform proponents. From the perspectives of the employment based immigration legislation, there lie some uphill battles. We will closely watch and monitor the drama for the next two or three months. Unless any EB based bills are compromised and passed during the period, the chance for the EB reform will practically evaporate in 2008. Please stay tuned.

@snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

@poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
Seems like there are victims falling for this modus operandi time after time.

I think each person can write their own story and here are a few writing points as appropriate.
1) How long you have been here, and how despite your contributions in work and taxes, creativity(of jobs?) and maintainineg legal status, you have been left in a difficult spot of no permanency of status.
2) How you have benefited from this country and would like to give back, and understood that to be the tradition on which america was built.
3) If you have US born Children. That it would be unjust to ask them to be brought up elsewhere.
4) That your entrepreneural ideas have been held back by your inability to have permanency of tenure here.
5) That you never understood that to be the way it is done in America. However, a little voice keeps telling you to never quit on America, as she eventually gets it right.
6) That you have been unable to buy a home due to this issue and wonder why it is that you can't help yourself while helping America. That you have a stable job, 20% down, excellent credit and the whole nine yards except the green card. That there are thousands like you waiting to jump in.
7) How the US gov't bureaucracy has "wasted" over half a million green cards already allocated annually by congress, all happened while there were years long queues and merely recapturing those visas has been blocked by gridlock.
8) Mention Immigrationvoice in your e mail, and state that we have some great ideas on how to make the EB system more efficient and would love to be engaged in improving the system.

I did a quick search and did not find answer to this. Apologise if this is a repost.
But a co-worker of mine wants to travel on AP. After coming back, he will join my company (right now he is a contractor) as a perm employee on H1. Is it possible and allowed? Can he transfer H1 after using AP?
Our company attorney confirmed that his H1B will remain valid even after using AP. But she is not sure about transfer. I will post her reply once she gets back to him. But in meantime, if anyone has any idea about this, please share.

All this memo states is that USCIS will not automatically expedite the FBI name check simply because a writ of mandamus is filed. This memo signaled a national shift in the way USCIS responds to these types of lawsuits.
The U.S. Attorney's Office will now fight the writ of mandamus lawsuit by filing Motions to Dismiss and Motions for Summary Judgment. While this obviously lengthens the time it takes for a case to proceed, it is still very possible to win and force the government to adjudicate the application.
Hope this clears up any confusion,

I dont work for consultant and yet I relocated last year. I admit its less frequent when you work directly for a company. I work longer hours not because I am told to, but it makes me feel more secure in my job by doing so and by making myself more useful than neccesary. WHy? coz I cannot change employer and keep my greencard process intact and continual. Its has to be started from scratch. Not affordable. Hence the longer hours. Is it forced? No. Is it fair. Absolutely not.
Finding a local to marry is not an option. Why? Firstly, many of us are already married. Secondly and more importantly, if you marry a local with the intention of obtaining immigration benefits, you are breaking the law. I dont mean to say that marrying a local is wrong, but it is illegal if you are doing it only for immigration benefits resulting from marrying a citizen and you could lose that greencard if things go haywire. To quote Shushterman, an immigration lawyer and former USCIS employee: If you are caught doing something illegal by USCIS, you are better off robbing a liquor store than marrying a local with intention of greencard. USCIS may pardon you if you robbed a liquor store, and still give your greencard but not if you married a citizen with intention of immigration benefits.
Now, coming to rights and privileges, privileges wouldnt exist unless you had the rights. Privileges granted by Government to public are based on rights. There are some things that the seeker calls rights and the person who grants them calls them privileges. If you want to be forceful, you have to call it a right, not a privileges. We call "Human rights" rights for a reason and not "Human privileges". See, privileges imply a hand-out. Rights imply justice. There is a difference between hand-out and justice.

I dont mean to say that marrying a local is wrong, but it is illegal if you are doing it only for immigration benefits resulting from marrying a citizen and you could lose that greencard if things go haywire. To quote Shushterman, an immigration lawyer and former USCIS employee: If you are caught doing something illegal by USCIS, you are better off robbing a liquor store than marrying a local with intention of greencard. USCIS may pardon you if you robbed a liquor store, and still give your greencard but not if you married a citizen with intention of immigration benefits.
Now, coming to rights and privileges, privileges wouldnt exist unless you had the rights. Privileges granted by Government to public are based on rights. There are some things that the seeker calls rights and the person who grants them calls them privileges. If you want to be forceful, you have to call it a right, not a privileges. We call "Human rights" rights for a reason and not "Human privileges". See, privileges imply a hand-out. Rights imply justice. There is a difference between hand-out and justice.

my I-485 was pending from 2001 and then my case was transfered to NBC I had an interview and then I got the I-797 Welcome Notice welcoming me as a permanent resident of the United States and it said on the notice you will get your green card in the mail in about 3 weeks and then checked my online status it said we ordered the card for production
ok at this point everything is looking good
and then after 5 days check my status online
found the following :

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on November 29, 2007, and are now reviewing our earlier decision.
#################################################
am I in trouble?!!!!!
ok at this point everything is looking good
and then after 5 days check my status online
found the following :

This is what I mean by fingerpointing. So why are u so special? Just because u claim to be honest u must not point fingers at others. I am not criticizing u or not arguing, but fingerpointing will not lead to anything constructive. From what I have done so far, I have no clue if I have done something wrong, u r already pointing finger at me.
People in the past and currently are working hard to achieve their goals, fingerpointing and blaming others for the situation will never help.
