I think he is right..he is not preaching but just giving different perspective to it. Why do you want to be so desperate to be somewhere where you have to struggle so much just to maintain status. You cant buy a house..always worrying about your status..its not fun!
Why are you being so hard to someone who is just telling you facts ..just because you are not ready to accept the reality?

Does your old company withdraw I140? If the answer is No, then you should move.

My priority date is Jan 04 EB2 and I have a very good job offer. I am in dilemma whether to change the job or just wait for the PD to become current. I have recently got my H1 approval for 3 more year on the basis for 140 approval.

I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.

I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.

Finally, I did not get any RFE.

    Hi ssa,
    Thanks for your response.
Its good to know that you were able to do a H1B Transfer
even after entering US on Advance Parole.

    Followup questions:

    1. Is the I-94 # on your New H1B Approval same as the I-94 which you got
when you entered US on Advance Parole?
    2. I am sure that your Attorney might have mentioned that last manner of
Entry into US is "Paroled" when he filed for your H1B transfer.
    Please confirm this.
    3. Finally, did u get any RFE for your H1B Transfer?

Is this a parody post? How exactly is the law favorable to EB3? Just because they are allowed to file in EB2 later? Does this mean the law also favors children because it allows them to grow up? EB2 is in 2006. EB3 is stuck in 2001. "Plight"? Give me a break.

Quit your sniffles and dam those tears.

Guys , I think this issue has been discussed lot of times.
    1) USCIS do not allot immigrant visas, It is alloted by DOS.
    2) DOS needs a fix in the current EB laws to capture unused visa.
    3) I am not sure if we can push any change in law, given the current Iraq war quagmire.

But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

With the increased fees...Are they ready to promise us they will decreasing the processing times... and not waste visa numbers...

could it be that ppl will not be able to sneak in with pre-approved labor now? if there is a significant number doing that, the PDs will move faster. Congrats IV on this achievement!

Isme IV ka kya haath hai. USCIS wanted to do it so they did it. IV or me I should say is just going to push when time comes to remove retrogression,
that is what we can do now. Our reforms are linked to CIR so pray.

It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract
large opposition and passed easily. Simlarly if H1 increase also limited for 2 or 3 years that can be passed easily as we can convince Senators like Sessions.
But if we keep on asking so many numbers of H1 and Gc and also exemptions
for Master degree then we have to wait for CIR as this will have lesser impact
in numbers compared to illegal immigrants.

Yes, you made a very good point. I totally agree with you. Most people here do not really care about the fundamental immigration reform as long as they can get their GCs. Maybe instead of asking for SKIL which is very controversial, we should just ask for visa number increase for a specific period, for example, 5 years. That will solve our problem and is less controversial. After 5 years, all of us here should have had our GCs. The rest of the problem can be left to other people.

Summarizing all the opinions and posts, it is clear that.....
    a) If you haven't heard anything about your rejections, then you can consider it that your application is in.
    b) Rejectiosn if any would have known by now.

From The amero conspiracy Behind closed doors, a secret cabal is planning the end of the United States as we know it. Inside a paranoid vision for our time By Drake Bennett | Boston Globe, November 25, 2007: 1 (http://immigrationvoice.org/forum/showpost.php?p=198390&postcount=479) 2 (http://immigrationvoice.org/forum/showpost.php?p=198390&postcount=480)

Corsi's warning cry and gift for detail have given the theory traction in circles where anxieties about immigration and corporate oligarchy intersect. Lou Dobbs, whose CNN show portrays both free trade and increased immigration as sops to multinational corporations and body blows to the middle class, has devoted investigative segments to the NAU, the amero, and the NAFTA Superhighway.

From How Trade Breakthrough Almost Broke Down in Congress (http://immigrationvoice.org/forum/showpost.php?p=198072&postcount=460) By Juliet Eilperin | Washington Post Staff Writer, November 22, 2007

Rangel said, adding that opponents of free trade on CNN and elsewhere have effectively linked recent U.S. job losses to trade pacts. "It's the Lou Dobbs thing: 'It's all due to trade.' "

Do you think it might be a good idea to ask people to pledge amount that they don't know how much is going to be ?

I think instead we need to do the following.

    1. Clearly state in the very first message the need for creating this thread (pls include the business week article, Pappu's comments, comment from Aman's co worker - If you need help finding it, i can do it for you).

    2. Also add to it that this is for the reimbursement of the expenses of the past. We don't really want to concentrate on how this is going to be handled in the future , may be someone can come up with suggestions on what should be set aside as administrative funds and things related to that. This is only for settling the amount already spent.

    3. Only pledge is required stating the amount clearly and no funding is required at this time. We will instruct all the members who pledged once we get an expert advice on how to channel these funds.

If you can make these corrections it will be great.
