Friends,
I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

For me I have to renew H-1 visa every year wich will be same as EAD/AP. Each time I would go for H-1 visa I will be stuck for security clearance making me stay outside US without work for unknown number of months which is the worst experience that can happen to anyone not the grey area of AOS.
But to get EAD/AP I do not need to step outside US neither do I need to wait for security clearance and I hope to travel home when I want.
So to me EAD/AP is better than H-1visa.
If I get EAD/AP can I go for H-1 stamping?

Did you even read my post and the pdf link. BTW, pdf link refers to Aug 21st, 2009 much before this memo came out. Even if memo is withdrawn, how that is going to change the points agreed by the court?

I suggest that you go thru pdf links in my other posts for this topic. All these decisions refer to issues pertaining to H-1B working at the end-user client thru multiple layers. This memo does not make any difference that way. Like I said before, this memo just make the interpretation public knowledge.
Why these H-1B cases have been denied in last years and why these denials were not reversed by appeal court? These answers should enlighten you.
Just harping "illegal memo" does not change anything.

It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.

It would have been great if everyone could have a similar white t-shirt with a slogan on front that said
"Ask me about legal immigrants"
and on the back
"www.immigrationvoice.org"
Obviously this is not possible at this stage. How about everyone at least pinning something similar that is printed on a paper on their shirts? Similar to how runners do (http://z.about.com/d/studenttravel/1/0/s/H/ujena-marathon-solo-2.jpg)
It will help the organizers and any media persons in identifying the rally participants easily.

The only way to counter this is to get our story out in the media. i joined the forum today and went through a lot of mails on the forum. i saw pappu making appeals to members to help him write to reporters. I saw state chapter threads and only few members have actually signed up for work. see only a handful responded. others simply come on forums and rant. but only few actually do the work. I also observed members critical of Iv or telling IV to do this or that, instead of doing something themselves. My other observation is that members do not contribute money and come to this forum for free advice. Nothing in this country is free but IV is providing this forum and also free advice from lawyers. But members are simply taking advantage of IV and not paying back what they are getting from it. This has been my personal observation. Members we have seen how visa bulletins affect us and demoraliize us. why dont we all do something instead!

How do you know that all the unused visas go to EB3 before go to EB2?
That is the way the USCIS is interpreting the laws and actually doing it that way...There are two different caps applied to you....The EB2 cap of wharever numbers available and the country cap of 7% for all of china EB+FB combined together.......It is true that there are more EB2 numbers available...But as the country quota for CHINA/India is over they are flowing to EB3 ROW instead of flowing horizontally to EB2 china....There is a big discussion about how this flow occurs and if it is fair or not...The title of that thread is 'Unused visas' Reading that would be helpful to you...

Frankly donot know....Last year when they passed 2611 they had put conditions in it to delay the implementation..They can put delay again...That is possible....

Hi I am a physician in Oregon and my parents are visiting too in July. I called Kaiser regarding this, and this is what I was told.
1. they can get insurance since Kaiser does not need an SSN for the application.
2. Every Plan has a deductible $, an out of pocket maximum $, and a co-insurance $ amount.
So,
Plan A: Deductible 2500, Co-insurance 22% of all inpatient cost upto max of $22,000.
Plan B: Deductible 6000, Co-insurance 50% of all inpatient cost upto max of $50,000.
Essentially none of these plans are a 'good deal'. But remember its easier to pay back a loan of 22k - 50k than to pay back 100-200k.
Also since Kaiser is an HMO, and has its own facilities in the west coast and Hawaii, 'accepting insurance' is not a problem.

Lets say they have quota system to avoid the concentration of 1 country, then they should have some flexibility to adjust the country quotas based on the backlog too, certain % of EB numbers goes to clear the backlogs each year, that way everyone will remain at about the same level of retrogression, EB-2 RoW current and EB-2 India @ 2006 level and on the same line EB-3 RoW @ 2005 and EB-3 India @ 2002 level is ridiculous and just plain insane. I have read this thread and others, and I think I understand a little on how the process works. I am looking for your gut-feeling answer if I should apply for 485 or wait till I get married. Let�s assume that my marriage will take place only after one year from now.
I know it�s a very very tricky situation, I am very confused. Obviously, my preference is to wait for a longer time to get my GC, than separated from spouse for years.
Should I apply for 485 or not?

I received a sms saying that my case status has been updated (weird they sent it @ 9:25 pm PT). I was like here comes another biometrics appointment... but still let's check the status online. To my surprise and by god's grace, case status was changed to "Card/Document Production" (still cannot believe it). I dunno what triggered this but i did contact my Congressman yesterday. My wife's status has also changed to "decision" - should move to "Card production" soon.
My suggestion to all of you - please don't lose patience and do whatever you can from your end to expedite your case. It's your GC and you've to make sure you get it. Contact I/O, infopass and congressman/senator. Don't expect anything from your lawyers as they only care about money and it is in their best interest to see your case pending (more RFEs, EADs, APs, etc).

i dont think they are hiding any numbers from EB3 ppl..thay are just following the rules book to the letter...
and since only one group of ppl are affected..they dont want to take the pain of fixing the immigration mess...4-5 years is a normal lag for ROW and non retrogressed nations...
You can go to USCIS website they have
information of Freedom of information act..specified..you can get ur dose of reality check if you want...
instead of that you can be more proactive and support IV campaings!
