Just today I received a email from TX CIS.....saying......
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
PD: 01/29/07
485 Filling: 07/12/07
Receipt Date: 08/17/07
Got EAD, AP approved. Just last week I did my finger prints.....
I don't where I am and what would happend to my case....I am planning to change my job using AC21...is that going to impact anything to my processing????
What do you thing about the time frame for my case based on my PD????
Guru's please advice....as I am planning to chnage my job in March or April/08.....

2006 PD filers dont worry abt spouse 485. Your PD would become available only after couple of years. My PD is Sept 2005 and I dont anticipate to get my GC within 2yrs. For reference look at the PERM data that is published, you would get a good idea.

Logiclife made a good point "immigration right" but I dont know how this thread got morphed into marrying local and what not.
The point is your whole attitude is wrong. First lets get one point straight. We are doing this country no favour by working here nor is this country doing us any favour by letting us work here. Its a mutually benefecial scenario. Since we are contributing to this society and following all there rules we are asking for immigration rights.
To ask for something, you must first believe that you deserve it. The illegal aliens belive in there cause (even thought they broke the law) that is one of the reasons everyone talks about there cause including the senators, president and the media.
People like you on the other hand seem to belive in taking handouts and nobody cares about such people. unless we belive we truly deserver it nobody is going to give a damn about us.
I dont mean to say anything personally to you I am just addressing people who seem to disagree with logiclifes well articulated argument about immigration right.
In same vein, driving on road is privillege not a right.
With 'privillege' you have to follow existing rules religiously then if it was a 'right'.
In anycase, what we can only do with existing law is work with law makers and not protest.

But, because everything that I have learnt seems to indicate that EB-3 ROW is getting a lot of visa numbers. So why the hell would it be stuck??

I want to bring to your attention that it�s been nearly a �Decade� since we saw any meaningful Visa Date movement from year 2001 for EB-3 Green Card applicants from India.
It is important to know that despite of severe visa retrogression and random visa cutoff date movements, USICIS or DOS hasn�t released any official information on how many Adjustment of Status applications are pending at USCIS under various categories which leaves thousands of AOS(Adjustment of Status) applicants in complete darkness and dependent on guessing games by various Law firms.
A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.
It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.
We understand that you work with in the limits of the law as set by the Congress and are limited by various constraints that are beyond your agency realm of work. We appreciate your hard work and sincerely thank you for all the hard work.

service cntr lady said that they sent the applications back. They do not use overnight Fedex like you and me,they use regular mail.and it could take 4 wks too ..so will have to wait again for this? rejection and then refiling the same stuff?
She just said that to get rid of you over the phone. Lot of people have called USCIS and no one heard of any rejection notice being generated. I think we should be okay!

For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:
1) Call Customer Service @ 1 800 375 5283
2) Continue in english, hit 1
3) To check the status, hit 2
4) Know your receipt number, hit 1
5) Enter Receipt number, and then for SRC, hit 1
6) Confirm Receipt Number, hit 1
7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".
Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.
Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.
Again, the sequence is:

I'm getting married in August and my wife will be here in Sep/Oct. My PD is pretty recent - May 2007 EB2 (India). I'm planning to file my 140/485 (concurrent) and maintain my H1B for now and also bring my wife on H4. As long as she wants to be on H4, I'll maintain my H1 and once my PD comes CURRENT again, I'll file her 485.
Now, I've heard that my 485 won't be approved before my date is CURRENT again. Once the bulletin releases and if my date is CURRENT, I'll send my wife's papers to USCIS immediately. But it seems like I can get FP notice even before my dates become CURRENT. That case, my FP and other stuff might finish early and my wife's late. Does this affect her case in anyway as there is every chance that my 485 gets approved early and hers late. Will she be "out of status" because of her 485 pending and mine approved.
What do you suggest ??

Got a call this morning (at 8 AM) from an IO at local office telling me that my case was approved.
After an hour, around 9 AM, I got another call from USCIS. I was pleasantly suprised with how polite the lady was. She told me that she was following up on the inquiry I had sent. She repeated what I already knew, that my case was approved on 10/26. I am assuming this was in response to the letter I had sent to USCIS secretary Napolatino. She congratulated me a couple times and I thanked her for calling me.
So folks who are waiting, please try everything you can. Draft one good letter, and send it to everyone you can and hope that at least one of those authorities will look at your letter and do something about it.
I also want to thank SeekerOfPeace who shared his letter to Sec. Napolatino with me.
