    We can always convey that the amounts can and will be adjusted based on need. But let's set a target. Disclose the goals. Not the exact dates and times and the kinds of meetings being attended nor do we need a detailed daily report of how the money will be spent. That is micro reporting and I think we all trust IV enough to know that the money is being well spent. All targeted funding drives help us do is plan better and focus better.

    Let's be vigilant and worry about the things we can worry about.

    Getting a little philosophical:
    I agree with you that the outside world is cruel. But the journey's been alright till now hasn't it. I was a huge supporter of the Gandhigiri campaign and was one of the primary reasons why I got involved with IV in the first place and am proud of it. We need more voices and more participation.

    As long as people support the cause and organization "Willingly" we will have infinite horizons to grow. The moment you bring "Burocracy" in, ultimately momentum will die.. may be slowly or quickly. Historically, IV threads are the major attentive media to declare the existence. We should not kill that with any enforcement of "Paid membership"...It is always hard to wake people. If that would be easy than nobody would have used the word "Struggle"..right:). On other hand yes there is a dire need of increasing financial strength exponentially and that too quickly is at high priority. We need to think and find other ways and resources.


    that is the challenge. but it is also a slow process. it took a couple of movements before a lot of members got on board. more results will bring more members. I support issue based funding. announce what the money is needed for and ask members to contribute. members who have a vested interest and are motivated in an issue will contribute. Would a person who vies for GC contribute for an H1B cap increase issue and vice versa?

    it is also a guage of the support that IV has for an issue and its resolution. many members may not agree with what IV is doing and hence will not contribute. It makes for good collective decision making.

    My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.

    My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

    please advice.

    I also got an I-140 REF on A2P. USCIS requested my company's 2006 Tax Return, my 2006 W2 and 3 latest pay stubs. I am still waiting for my employer's tax return, However I am going to apply I485.

    I have been a IV member since 2006 . I have seen the ups/downs . .

    A sad truth that we all want to do hero worship. We all want someone to do something for us while we can watch and comment on it. But this is a good thing because even though we are not doing anything at least we are saying something. I wonder why Indians are doing so much complaining.

    Where are China and ROW people? Are they not in pain? I have not seen them on the forums.

    I got responses from pappu and Logiclife during the months of december and january. I didn't ask them any questions in Feb. so I did not notice they were quiet.


    And the drama continues...

    All I had asked was how the older IV core members were doing as I hadn't seen them online in over a year. But as usual a simple question like that and a request for some updates kicks up a storm!!

    Once again, this was not to start a storm. I honestly just wanted to find out how the older core members were doing. WaldenPond, thanks for your first response.

    What you said was absolutely correct. However most of the times the delays caused in big companies are due to various layers of communications as well as approvals.
    I'm a live example of how i lost the opportunity to file 485 before Dec31/2004 for EB3 category, just because of unnecessary (so called) procedural delays
    NOw, this new rule in place will certainly prompt for good changes in the big companies if they truly want to sponser GC
    Yes, they must act in a timely manner. one way to do is HR should get all the necessary approvals from managers / directors so that they don't lose time. Secondly my observation is there is always a substanial delay at Attorney's office(few exceptions are there) to prepare the paperwork.



    I dont think companies are really geared to file for 140 within 45 days of labor approval.

    Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.

    All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

    I don't like idea of making IV a commercial-type business. IV is for legal immigrants and it should be funded by Legal Immigrants, however, practically its not that easy as it sounds, and more importantly its not working enough for IV to operate and generate results that we are waiting for.

    Problem is not that we don�t have money as small as $20, issue is we don�t want to pay. The reasons could be a)- we don�t understand importance of IV, b)- don�t trust IV fund management, c)- love freebies, d)- don�t have money e)- everything else.

    Lets talk about e)- there are 31000 reasons not to donate to IV. Well no matter how hard we push there will be people who will never contribute. I met quite a few who been saying �yeah� for quite sometime and visit IV almost daily but have not contributed $0.01. Can�t help them who can�t help themselves.
    d)- don�t have money: smells fishy, we are Hi-Tech workers, get paid really good and can�t donate $20, I don�t buy this idea. Better explain me next time.

    c)- love freebies: its great concept, I like it too, but when IV is fighting for us, the whole legal immigrant community, can�t we donate $20 for our own future. Lets take it as a lottery, we buy ticket, we may win and may not win, compare it to IV, we donate to IV, IV may be able to resolve issue before we even reach there in GC process (just like name check), and IV may not help retrogration, but still we come to forum, get information about process, discuss our own case, get seniors/gurus review of our own GC case/issues. We can�t go wrong with that. Its doable, just $20 for all this.

    b)- IV fund management: well IV has 25000 dedicated registered members, WOW, but way more than that IV has un-registered unknown number of enemies. Exposing everything on web is not a great idea, its like playing poker with your cards open. IV registration process is very simple and hence ANYONE can join and get sensitive info very easily and may use it against us. To protect that info IV is working on local chapters, local chapter registration is based on personal interaction, almost guarantees us that member is really legal immigrant. Once we are local chapter member then you get all such info in personal Inbox. You can see, verify, and discuss IV spending, see all transparent at this state chapter level. Just join them, no fee, its free!

    a)- don�t understand importance of IV: this is biggest single factor so far, folks who are in their 1-3 years of H1, assumes that by the time they will come to advanced stage of GC everything will smooth by then, as of today there is no reason for them to think about it. One very huge mistake they are making of thinking that GC queue will decrease when they get in line. It won�t. It will keep increasing exponentially simply because number of cases come in line are far more than number of cases exit the line.
    Delta = (# of new cases in the line) � (# of cases exiting from line)

    Trust me this Delta is getting bigger and bigger for you. Donating to IV may not seem important right now, think again you are going to invest in your future. IV may resolve this issues before you reach there. Ultimately saving you 2-3 yeas in GC process, you can earn more $$ in those 2-3 years and enjoy GC benefit too.

    Wow, all this explaining to get $20 from each member. Please point out if there are other reasons for not donating to IV.

    I am married too, but i only said that there are other easier paths aswell.

    Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
    As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.

    Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.


    What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

    It's a good suggestion, but I think free period should last only for a couple of weeks.
    Suggestion: IV membership should be free for the first 3 months, after which there should be a minimum $20/per month to keep your membership and log in.
    Also at that time a member needs to update his/her profile to include contact information. This way we encourage new people to come study the issues, gain trust with IV.

    In case If I wanted to have my attorney, I need to cough up $275/hr and 5K check upfront and he feels his fee may add upto 10K by the end of all this. So not sure whether just go with insurance agent's attorney for the time being and just wait how it goes, even if the case goes against me as I don't have much bank balance etc I am not sure what they can get out of me..

    Any thoughts??

    If I were in your place, I would not spend money to hire my own attorney- not yet. I would let the insurance attorney handle the initial few months, and only after things start happening, I'd think about paying an attorney myself. Meanwhile, use this interim period to look for a very good attorney- meet with a couple of them and decide which one would you choose, if you had to. Personal liability defense is handled best by firms specialized in tort defense (eg. who defend medical malpractise suits), and NOT by trial lawyers who are mostly experienced with plaintiff's cases.

    Another thing, since YOU were the one who seems to have experienced most injuries in the accident, didn't you get letters from trial lawyers offering to sue the other folks and ask for damages (since THEY were at least 20% responsible for your injuries)? Such trial lawyers do not take any money from you upfront- they only take a % of the money recovered. This might make things too messy for you to handle- but give it a thought; sometimes offense is the best defence.

    Some folks have advised you to move money etc out of this country- but remember this can backfire. Any financial transaction you do now, will be heavily scrutinized if there is a trial and will be treated as fraud if they are seen as attempts to hide money. This will bring in additional charges and the court will order for reversal of all these transactions. So tread carefully, my friend.

    Just did a rough sketch on paper, and then drew it up in vector, no secret really... and to be honest it isnt perfect at all, but turned out ok.

    I guess drawing it at a larger scale then shrinking helped with some of the fine tuning.
